By accessing or using the BistroOS platform ("Service"), operated by Hue Ky Company ("Hue Ky," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

BistroOS is a restaurant operating system that provides online ordering, in-store kiosk ordering, point-of-sale registration, and kitchen display functionality. The Service enables customers to browse menus, place orders, and make payments for food and beverages at participating restaurants.

3. Eligibility

The Service is available to anyone capable of entering into a binding agreement. By using the Service, you represent that you are at least 13 years of age and have the legal capacity to agree to these terms.

4. Orders and Payments

4.1 Order Accuracy

You are responsible for reviewing your order before submission. Once an order is placed, it is sent directly to the kitchen for preparation. Orders that have begun preparation may not be eligible for cancellation or refund.

4.2 Payment Methods

We accept the following payment methods:

• Online payments: Credit and debit cards processed securely via Stripe.
• In-store payments: Cash, credit, and debit cards processed via the PAX A920 Pro terminal.

All payment card data is tokenized by the payment processor. BistroOS never stores full card numbers, CVVs, or expiration dates.

4.3 Order Cancellation

Orders that have not yet entered preparation may be cancelled through the platform. Orders in preparation or ready for pickup cannot be cancelled through the platform; please contact restaurant staff directly for assistance.

4.4 Refunds

Refunds are handled on a case-by-case basis at the discretion of the restaurant. If you experience an issue with your order, please contact the restaurant directly. Refunds, when approved, are processed to the original payment method within 5–10 business days.

5. User Responsibilities

You agree to:

• Provide accurate information when placing orders
• Use the Service only for its intended purpose
• Not attempt to disrupt, overload, or exploit the Service
• Not use the Service for any unlawful purpose
• Not interfere with other users' access to the Service

6. Intellectual Property

All content, design, logos, and software associated with BistroOS are the property of Hue Ky Company or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.

7. Limitation of Liability

To the maximum extent permitted by law, Hue Ky Company and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, loss of profits, data, or business opportunities.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the order giving rise to the claim.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Indemnification

You agree to indemnify and hold harmless Hue Ky Company, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these terms.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

11. Changes to These Terms

We may revise these Terms of Service at any time by updating this page. The revised terms take effect when posted. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the state or federal courts located in Orange County, California.
